Ark8 Terms of Service
Document version 2026-10-17-181b4816
Effective to be confirmed
These Terms govern the Ark8 website and the Ark8 account. The application itself is licensed under the End User Licence Agreement, which covers what the software may do and what we are responsible for if it goes wrong. Both apply; where they overlap in respect of the software, the EULA prevails.
By creating an account or using the site you accept these Terms. When you accept them, at a sign-in on our website or in the app, or in the notice the app shows before you continue, we record which version you accepted.
1. Your account
You need an account to use Ark8. You sign in with Google or Microsoft or, once single sign-on is available and where your organisation has set it up, with its single sign-on, so we never hold a password for you.
You are responsible for what happens under your account, and for keeping your identity provider secure. Tell us at to be confirmed if you think someone else is using it.
One account is for one person. Do not share it. Seats are counted per person, not per machine.
You must be old enough to enter a contract where you live, and at least 16.
2. Plans, billing and cancellation
No paid plans are offered during the preview. Ark8 is free to use, there are no subscriptions or seats to buy, and the paragraphs about payments below apply only if paid plans are introduced.
When paid plans arrive, their prices, billing periods and what each includes will be on the pricing page, and these Terms will be updated before you are charged. Subscriptions renew automatically at the end of each period unless you cancel first.
Cancelling. Cancel any time from your account or by writing to to be confirmed. You keep access until the end of the period you have paid for. We do not pro-rate a partial period except where the law requires it.
Refunds. Within 30 days of a purchase, ask and we will refund it in full. After that, we refund where the law requires us to, and otherwise at our discretion. Consumers in the EU, the UK and elsewhere have statutory cancellation rights that these Terms do not reduce.
Price changes. We will give you at least 30 days' notice before a renewal at a new price, and you can cancel before it takes effect.
Tax. Prices exclude tax unless stated. You are responsible for any tax that applies to you, other than tax on our income.
Failed payment. If a payment fails we may suspend access after telling you. We will not delete your account's data for at least 30 days after a suspension for non-payment.
3. Organisations and shared sessions
If you share a session with an organisation, you choose who can see it: everyone in the organisation, or only its owners and admins. What is uploaded is described in the Privacy Policy — connection details and notes, never passwords or keys.
An organisation's owners and admins control who is in it, can see what is shared with it and can withdraw a shared item. If you join an organisation run by your employer, they have that control over what you share there.
Acting for an organisation. If you set up or administer an organisation for your employer or another business, you confirm that you are authorised to accept these Terms on its behalf, and they then bind it as well as you. A business that needs its own agreement — negotiated terms, a data processing agreement or an uptime commitment — can ask us for one at to be confirmed.
Do not put a secret in a note. Notes are uploaded exactly as typed.
4. Acceptable use
Do not use Ark8 or our site to:
- access any system you are not authorised to access;
- attack, scan or disrupt anything without the owner's permission;
- break any law that applies to you;
- interfere with our service, or with anyone else's use of it;
- resell access, or run our service on behalf of others as your own.
Ark8 is a tool for administering infrastructure. That it *can* connect to a machine does not mean you are allowed to. Authorisation is your responsibility and we cannot verify it.
We may suspend an account we reasonably believe is being used this way. We will tell you why, and we will restore it if we were wrong.
5. Our content, and yours
Ours. The site, the application, our name and our logo belong to us. These Terms give you no right to use our brand, except to say truthfully that you use Ark8.
Yours. Your runbooks, sessions, notes and configurations are yours. We claim no ownership in them. We process them only to run the service, as described in the Privacy Policy, and we do not use them to train anything.
Feedback. If you send us a suggestion we may act on it without owing you anything for it. We will not claim you endorsed us.
6. The service may change, and may be down
We may change the site and the service. We will not remove something you are paying for without notice and, where it matters, a refund of the unused period.
We do not promise the site or the account service will be available continuously. There is no uptime commitment on any plan unless we have signed one with you separately. Ark8 connects to your infrastructure directly, not through us. Your first sign-in needs our sign-in service, and Ark8 checks your sign-in with it each time it starts. If it cannot reach the service, Ark8 opens with your stored sign-in and checks again once it can; only a refusal from the service signs you out. Ark8 keeps working without us; only its organisation features need our service, so an outage on our side pauses those until the service is back.
7. Third-party services
Signing in uses Google or Microsoft or, once single sign-on is available, your organisation's identity provider. The assistant uses Anthropic with your own API key. Each has its own terms, and we are not responsible for them. When you connect Ark8 to services, those terms are between you and them: your servers and clusters, Vault and the identity provider you sign in to it with, Docker engines, a SIEM, Slack or a webhook, a Git remote or GitHub, and Google or Microsoft calendars. The same goes for the public Helm chart catalogues and Artifact Hub that Ark8 reads.
8. Warranty, and what we owe you
The site and the account service are provided "as is" and "as available", without warranty of any kind, to the fullest extent permitted by law. The warranty disclaimer in section 7 of the EULA and the limitation of liability in section 8 of the EULA apply to these Terms as though set out here in full, including the cap on our total liability and the exclusions that cannot lawfully be applied.
We say this plainly because it matters: Ark8 runs destructive commands on your infrastructure at your direction, and we do not carry the risk of what those commands do. If that is not an acceptable allocation of risk for your use, do not use Ark8.
9. Ending it
You may close your account at any time, with Delete my account on our website (Account → Your data). If you own an organisation, transfer it to another member first; if you are its only member, close it on its Organization page (Close organization), or, if it has single sign-on set up, write to to be confirmed and we will close it. We may terminate or suspend your account if you materially breach these Terms and do not fix it within 14 days of us telling you, or immediately if the breach is section 4 (acceptable use) and serious.
On termination your licence ends and you must stop using the software. You can download a copy of your data from the same page. The Privacy Policy says what is deleted and what is kept. Write to to be confirmed if you cannot sign in.
10. Disputes
Talk to us first. Write to to be confirmed before filing anything. Most disputes are a misunderstanding and we would rather fix it than litigate it.
Governing law. These Terms are governed by the laws of to be confirmed, and its courts have exclusive jurisdiction — except that if you are a consumer, you keep the protection of the mandatory law of your country of residence and the right to bring proceedings there.

11. General
Changes to these Terms. We will post the new version with a new effective date and, for a material change, email you or tell you in the application at least 30 days before it takes effect. Continuing to use the service after that is acceptance. If you do not accept it, cancel — and if the change is material and you cancel because of it, we will refund the unused part of your period.
Severability. An unenforceable provision is modified to the minimum extent needed, or severed; the rest stands.
No waiver. Not enforcing something is not giving it up.
Assignment. You may not assign these Terms without our consent. We may assign them in a merger, acquisition or sale of assets.
Entire agreement. These Terms, the EULA, the Privacy Policy and NOTICE are the whole agreement between us.
